My friends 335xi(just got it- obviously 6sp black) "malfunctioned" and he tossed her over a curb. It popped up on the display as "brake and drive systems malfunction!"

      335i for sure.

Turbos are like cheating.  Ask Braun how much $$$ cheating gets ya!

Two different cars. The 335 is going to be a faster and more luxurious street car. An E46M3 would be a faster and more raw track car.

If you want straight line speed, absolutely buy the 335.  You have to truly want everything the E46 has to offer, in order to put up with the neediness of the car. But the reward of the E46 M is far greater than the 335, from a driving enthusiast point of view. Both great cars in their own right. But the E46 M3 is so far from over rated.

The 335i is going to be great but the reliability of the turbo motor is questionable.  I would go with the e46 m3 if it was my money.

e46 looks better.  If this is going to be a daily driver/only car, go with the 335.  If this will be a fun toy that you can spend some money on, go wit hthe e46.

That they are.  A carbon roof takes away some weight though ;)
